All rights reserved. http://www.rootsweb.com/~usgenweb/copyright.htm http://www.rootsweb.com/~usgenweb/pa/lancaster/ _______________________________________________ Allegheny/Robeson Twp - 60 acres Written: April 10, 1795 Recorded: April 23, 1795 THIS INDENTURE, made the twenty-third April 1795, between Jacob WALTER, Robeson Township in the County of Berks and State of Pennsylvania, yeoman, on the one part, and John FRIES of the same place, yeoman of the second part, WHEREAS by a certain proprietory deed bearing the date the 6th day of March, 174?, there was surveyed by virtue thereof into a certain Jacob WYLER, a certain tract of land adjoining Adam Morgan and William Harford at Allegheny, then in the county of Lancaster, ---now the aforesaid township of Robeson, County of Berks containing 60 acres and the ----being more or less, as in and by the said warrant and the surveys remaining in the Surveyor General's Office at Philadelphia, may more full and at large appear, and WHEREAS the said Jacob WYLER by his assignment of the said warrant bearing the eleventh day of November 1765 ---confirmed all his right and title of the said warrant unto Michael WALTER (then to said Jacob WALTER) in fee as by the said assignment may at large appear. And the (Michael) WALTER, being so thereof seized departed this natural life but having first made his testament in writing bearing the date the 29 April 1777 and therein and thereby amongst other things did ...in the words following, to wit, "Thirdly I give and devise unto my son Jacob all sixty acres of land more or less which Jacob liveth on, but not till after his mother dyeth and then he shall have it to himself and his heirs forever, as in and by the said last will and testament duly proven and remaining in the Register's Office at Reading in and for the County of Berks, may more fully and at large appear, NOW THIS INDENTURE witnesseth that the said Jacob WALTER for and in consideration of the sum of one hundred and fifty pounds lawful money of Pennsylvania to him in hand well and truly paid by John FRIES at and before the ensealing and delivery hereof the receipt whereof the latter does hereby acknowledge and thereof and of every part and parcel thereof, ...for ever discharge the said John FRIES, his heirs and assigns by this present hath bargained, sold, aliened eufeoffed, released and confirmed and by these presents that the above mentioned tract of land containing 60 acres and the usual allowance being the same more or less,as aforessaid, together also the all and singular the houses, buildings, ways, woods, waters, water courses, rights, liberties, priviledges, improvements, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions, remainders, rents, issues, and profits thereof and all the estate right and title, interest, and also posessions property claim and demand whatsoever of of him the said Jacob Walter of in to and out of the hereby granted premises and of every part and parcel thereof. To have and to hold the said fore above and within mentioned tract of land containing 60 acres of land and allowances as aforesaid hereditaments and premises hereby granted or mentioned to be with the appurtenances unto the said John FRIES, his heirs and assigns forever, SUBJECT to the remains in of the purchase money interest, quitrents, thereof (if any) due and hereafter to become due for the same to the chief son or lords of the fee, And the said Jacob WALTER the said hereby granted premises with the appurtenances unto the said John FRIES and to hids heirs and assigns against him the said Jacob WALTER and his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim said hereby granted premises or any part thereof by from under him them or any of them shall and will warrant and forever defend by these presents, IN WITNESS whereof the said Jacob WALTER to these presents hath hereunto set his hand and seal on the day and year first above and aforewritten. Jacob WALTER (Seal), Eva (her X mark) WALTER, (Seal) sealed and delivered in the presence of us Maria (X her mark) BEAR, John BEAR, received on the day of the date of the afore and above written indenture of and from the above named John FRIES the sum of 150 pounds, it being in full the consideration money in said indenture mentioned received in full of me, Jacob WALTER, Eva (her X mark) WALTER...test. Maria (her X mark) BEAR, John BEAR, Berks county on the 10th day of April 1795. Before one of the subscribers one of the Justices of the Peace for the County personally appeared the above and aforenamed Jacob WALTER and acknowledged the above and afore written indenture to be his Act and Deed and desired the same might be recorded as such according to law. In WITNESS whereof I have hereunto set my hand and seal on the day and year abovesaid. Allegheny was originally in Lancaster Co, then became part of Robeson Twp., Berks County, by 1752.
